Rajesh is charged with theft under Section 379 of the Indian Penal Code. The charge sheet mistakenly states that the theft occurred on "5th March 2023" instead of "5th April 2023." Rajesh is aware of the incident and has prepared his defense accordingly. Since Rajesh was not misled by the incorrect date and it did not affect his ability to defend himself, the court may consider this error immaterial.
Example 2:
Priya is charged with forgery under Section 465 of the Indian Penal Code. The charge sheet fails to mention that the forgery was committed with the intent to deceive. Priya understands the nature of the accusation and has prepared her defense. Since the omission did not mislead Priya or cause a failure of justice, the court may consider this omission immaterial.
