Example 1:

Scenario: Ramesh, a resident of Mumbai, is summoned to appear in court for a criminal case. The court issues a summons under Section 62 of The Code of Criminal Procedure, 1973, but the serving officer is unable to locate Ramesh despite multiple attempts.

Application of Section 65:

  1. The serving officer visits Ramesh's house multiple times but finds it locked and is unable to serve the summons directly to Ramesh or any adult member of his family.
  2. The officer then decides to affix one of the duplicates of the summons to the main door of Ramesh's house, ensuring it is placed in a conspicuous location where it is likely to be seen.
  3. The court, upon receiving the report from the serving officer, conducts an inquiry to verify the efforts made to serve the summons.
  4. After the inquiry, the court declares that the summons has been duly served as per the procedure outlined in Section 65.

Example 2:

Scenario: Priya, who lives in a remote village in Kerala, is required to appear in court for a criminal proceeding. The court issues a summons under Section 63 of The Code of Criminal Procedure, 1973, but the serving officer is unable to serve the summons directly to Priya.

Application of Section 65:

  1. The serving officer attempts to serve the summons to Priya by visiting her house and the places she frequents, but she is not found at any of these locations.
