Explanation using Example
Example 1:
Ravi is a resident of a small town in Maharashtra. One day, he witnesses a robbery at a local store and reports it to the police. The police investigate the case and arrest the suspect. When the case goes to trial in the Magistrate's Court, the State Government appoints an Assistant Public Prosecutor (APP) named Priya to handle the prosecution. Priya presents the evidence collected by the police and argues the case against the suspect in court. Thanks to her efforts, the suspect is convicted and sentenced.
Example 2:
In a district in Uttar Pradesh, there is a sudden increase in cybercrime cases. The Central Government decides to appoint a specialized Assistant Public Prosecutor, Rajesh, to handle these cases in the Magistrate's Courts. Rajesh has expertise in cyber law and is able to effectively prosecute the offenders, leading to several convictions and a reduction in cybercrime in the district.
Example 3:
In a remote district of Bihar, there is a case of domestic violence that needs urgent attention. However, the district does not have an available Assistant Public Prosecutor at the moment. The District Magistrate appoints a local lawyer, Anil, to act as the Assistant Public Prosecutor for this particular case. Anil ensures that the victim's case is presented strongly in court. However, the District Magistrate ensures that Anil is not a police officer who was involved in the investigation, nor is he below the rank of Inspector, adhering to the provisions of Section 25.
Example 4:
In Orissa, the State Government exercises its control over Assistant Public Prosecutors through police officers, as allowed by the state amendment. In a high-profile corruption case, the State Government directs a senior police officer to oversee the work of the Assistant Public Prosecutor to ensure that the prosecution is conducted efficiently and effectively. This oversight helps in maintaining the integrity and thoroughness of the prosecution process.
