Application of Section 14:

Example 2:

Scenario: A Special Judicial Magistrate is appointed to handle cases related to cybercrime in District B. A cybercrime incident occurs in a remote village within District B.

Application of Section 14:

  1. The Special Judicial Magistrate has the authority to hold sittings at any place within the local area for which the court is established.
  2. The Special Judicial Magistrate decides to hold a session in the remote village to address the cybercrime case.
  3. The villagers and the accused do not need to travel to the district headquarters, as the Special Judicial Magistrate can exercise jurisdiction and hear the case in the remote village itself.

Example 3:

Scenario: A Magistrate appointed under Section 11 in District C is also given jurisdiction over a neighboring district, District D, due to a shortage of Magistrates.

Application of Section 14:

  1. The local jurisdiction of the Magistrate extends beyond District C to include District D.
  2. Any reference to the Court of Session, Chief Judicial Magistrate, or Chief Metropolitan Magistrate in relation to this Magistrate will be construed as referring to the respective authorities in both District C and District D.
  3. The Magistrate can hear cases and exercise powers in both districts, ensuring that legal proceedings are not delayed due to the shortage of judicial officers.
