Explanation using Example

Imagine a scenario where a theft occurred in Mr. Sharma's house on January 1, 2021, but he was out of town and discovered the theft upon his return on January 15, 2021. According to Section 469(1)(b) of The Code of Criminal Procedure, 1973, the limitation period for Mr. Sharma to file a complaint would start from January 15, 2021, as this is the date when he first became aware of the offence.

Furthermore, as per Section 469(2), when calculating the limitation period, the starting day (January 15, 2021) is not counted. If the limitation period was, for instance, three years, it would start on January 16, 2021, and Mr. Sharma would have until January 15, 2024, to initiate legal proceedings.
