Explanation using Example
Imagine a scenario where a person named Raj was involved in a minor traffic violation, which is punishable with a fine only. The incident occurred on January 1, 2020. According to Section 468 of The Code of Criminal Procedure, 1973, the period of limitation for taking cognizance of an offence punishable with fine only is six months. Therefore, the authorities must take cognizance of Raj's offence by July 1, 2020. If the authorities attempt to take cognizance of this offence after this date, Raj can argue that the period of limitation has expired, and the court should not proceed with the case.
