Imagine John is arrested for a minor theft and the Magistrate sets his bail at Rs. 50,000. John's family argues that this amount is excessive considering John's financial status and the nature of the offense. They file a petition to the High Court under Section 440(2) of The Code of Criminal Procedure, 1973. The High Court reviews the circumstances and agrees that the bail is excessive. Subsequently, the court orders the bail amount to be reduced to Rs. 10,000, making it more reasonable and aligned with John's economic situation and the gravity of the alleged crime, as guided by Section 440(1).
