Explanation using Example
Imagine a scenario where John Doe is convicted of a minor offense and the court sentences him to pay a fine of $500. John is unable to pay the fine immediately. Under Section 424 of the Code of Criminal Procedure, 1973, the court has two options:
- The court may allow John to pay the fine in installments. For example, the court could order that John pay $250 within the next 30 days and the remaining $250 in another 30 days.
- Alternatively, the court may suspend the execution of the imprisonment sentence and release John on the condition that he signs a bond promising to appear in court and pay the fine or installments on the specified dates. If John fails to pay the fine by the final date, the court can order him to serve the default imprisonment sentence.
If John had been ordered to pay compensation to a victim and he could not pay immediately, the same provisions would apply. Failure to sign the bond or to pay the compensation could result in immediate imprisonment.
