Explanation using Example
Imagine a scenario where a woman named Priya is the victim of a hit-and-run accident, resulting in severe injuries and a long-term need for rehabilitation. The driver of the vehicle is unidentified and untraceable. Under Section 357A of The Code of Criminal Procedure, 1973:
- The State Government has a scheme in place, funded in coordination with the Central Government, to compensate victims like Priya.
- Since the offender is not identified, Priya can apply to the District Legal Services Authority for compensation.
- Upon receiving Priya's application, the Authority will conduct an enquiry and is expected to award her adequate compensation within two months to assist with her rehabilitation.
- Additionally, Priya may receive immediate medical benefits or any other interim relief deemed appropriate by the Authority to support her immediate needs after the accident.
This provision ensures that victims of crimes, such as Priya, receive support and compensation even when the perpetrator is not found, helping them to recover and rehabilitate post the incident.
