Explanation using Example

Imagine a scenario where a person named John was acquitted of a theft charge by a trial court. The state, believing the decision was erroneous, filed an appeal under section 378 of The Code of Criminal Procedure, 1973 to the High Court. Considering the gravity of the offense and the possibility that John might abscond, the High Court used its powers under section 390 to issue an arrest warrant for John. Upon his arrest, John was brought before a Subordinate Court that decided to keep him in custody until the High Court disposed of the appeal. Alternatively, the Subordinate Court could have considered John's ties to the community and his past record and granted him bail while the appeal was being considered.
