Explanation using Example
Imagine a scenario where a person is convicted of theft by a District Court and is sentenced to a year of imprisonment. The State Government believes that the sentence is too lenient for the crime committed. According to Section 377(1)(b) of The Code of Criminal Procedure, 1973, the State Government can instruct the Public Prosecutor to appeal to the High Court for a harsher sentence, claiming that the initial sentence was inadequate.
