Explanation using Example

Imagine a criminal trial where the prosecution has closed its case, and after the defense has started presenting its evidence, a new witness who was previously unknown comes forward with information that could prove the innocence of the accused. The judge, upon learning about this new witness, decides to invoke Section 311 of The Code of Criminal Procedure, 1973. The judge summons this new witness to testify, even though the witness was not listed initially. By doing so, the judge ensures that all relevant evidence is considered to achieve a just decision in the trial.
