Example Scenario:
Imagine a situation where three individuals, Arun, Bina, and Chetan, are involved in a bank robbery. Arun planned the heist, Bina drove the getaway car, and Chetan entered the bank and stole the money. After the robbery, they were all captured by the police.
In this case, Section 223 of The Code of Criminal Procedure, 1973 would allow for Arun, Bina, and Chetan to be charged and tried together in court because:
- Arun, Bina, and Chetan are accused of the same offence (robbery) committed in the course of the same transaction, satisfying condition (a).
- Arun, who planned the heist, can be charged with abetment, and Chetan, who committed the robbery, can be charged with the offence itself, satisfying condition (b).
- All three individuals committed the offences in the course of the same transaction, again satisfying condition (d).
Charging and trying them together would be efficient and would ensure that the evidence and circumstances are evaluated in a cohesive manner.
