Explanation using Example

Imagine a scenario where a person named Rohit files a private complaint in a magistrate's court, accusing another person, Vikas, of a serious crime like kidnapping, which is exclusively triable by the Court of Session. The magistrate, upon reviewing the complaint, decides there is enough merit to proceed and issues a process under Section 204 of the CrPC.

Now, as per Section 208 of the CrPC, before the case is committed to the Court of Session, the magistrate must provide Vikas with copies of all the evidence recorded so far. This would include the statements of witnesses taken by the magistrate, any recorded confessions, and documents like CCTV footage or ransom notes that Rohit has presented to support his complaint.

In this case, if one of the documents is a lengthy diary containing detailed accounts relevant to the case, the magistrate might decide that it is too voluminous to provide a copy. Instead, Vikas would be allowed to inspect the diary in court, either personally or through his lawyer, to prepare his defense for the trial in the Court of Session.
