Explanation using Example
Imagine a situation where a person is found dead under mysterious circumstances. The police arrive and start an investigation under Section 174 of the Code of Criminal Procedure, 1973. They suspect that the death might be due to unnatural causes and want to gather more information.
Applying Section 175, the investigating officer issues a written order summoning two of the deceased's neighbors who might have heard or seen something on the night of the death. Additionally, the officer summons a friend of the deceased who had met with them earlier that day. These individuals are now legally bound to appear before the police and answer questions about the case. However, they are not required to answer any questions that might incriminate them.
After the initial investigation, if the police conclude that no cognizable offence has occurred, the summoned persons will not be required to attend court as the situation does not meet the criteria outlined in Section 170 of the Code.
