Explanation using Example

Imagine a situation where a woman's purse is snatched on the street by an individual who quickly flees the scene. The woman reports the crime to the police, providing a description of the perpetrator. A few days later, the police arrest a suspect based on the description provided.

In this scenario, the police believe it is necessary for the victim to identify the suspect to confirm that they have apprehended the correct individual. The police request the court to order an identification parade. The court issues an order under Section 54A of The Code of Criminal Procedure, 1973, for the arrested person to be identified by the victim.

If the victim had a disability that affected her ability to identify the suspect, such as a visual impairment, the court would ensure that the identification process is supervised by a Judicial Magistrate. The Magistrate would take special measures to accommodate the victim's disability during the identification process, which could include tactile or auditory methods, and the entire process would be videographed to ensure fairness and accuracy.

In the case of Uttar Pradesh, due to the state amendment, an Executive Magistrate would be responsible for conducting the test identification parade at the direction of the court.
