Explanation using Example
Imagine John, a shopkeeper, witnesses a theft at his neighbor's house by an individual who is a known proclaimed offender. John detains the thief and immediately calls the police. When the police arrive, they take custody of the thief. This is an application of Section 43(1) of The Code of Criminal Procedure, 1973, where a private person (John) arrests someone who commits a non-bailable and cognizable offence in his presence.
