Explanation using Example
Imagine a scenario where Rita, a housewife, is married to Arun, an engineer. Arun loses his job and starts neglecting Rita financially, despite having enough savings to support her. Rita, who does not have a job or any other source of income, struggles to maintain herself and their two-year-old son.
Rita approaches a Magistrate of the first class and files an application under Section 125 of The Code of Criminal Procedure, 1973. She provides evidence that Arun has sufficient means but is refusing to maintain her and their son. After reviewing the case, the Magistrate orders Arun to pay a monthly allowance to Rita for her and their son's maintenance.
The Magistrate also grants an interim maintenance order for Rita to receive financial support during the pendency of the proceedings. Should Arun fail to comply with the Magistrate's order, he may be subject to legal consequences, including the issuance of a warrant to levy the due amount or imprisonment.
