Explanation using Example
Imagine a situation where a group of tenants sue their landlord for the return of their security deposits. The court finds that only some of the tenants provided sufficient evidence to support their claim. Applying Rule 4 of The Code of Civil Procedure, 1908, the judge can grant judgment:
- In favor of the tenants who proved their case, ordering the landlord to return their respective security deposits;
- Against the tenants who failed to provide enough evidence, without affecting the outcome for those who succeeded in their claims.
This rule allows the court to deliver a fair judgment addressing each plaintiff and defendant individually based on the merits of their case.
