Explanation using Example
Imagine John had filed a lawsuit against a company for breach of contract. While the lawsuit is ongoing, John passes away. According to Section 146 of The Code of Civil Procedure, 1908, John's heir or legal representative can continue the legal proceedings against the company. This means that the right to sue doesn't end with John's death; instead, his heir steps into his shoes to continue the lawsuit.
