Explanation using Example
Imagine that a local district court issues an order for interim spousal support during a divorce case. One of the spouses believes the order is unfair and decides to appeal. According to Section 106 of The Code of Civil Procedure, 1908, the appeal would not be filed with just any court, but specifically with the court that would hear an appeal if it were a final decree in the divorce case. Thus, if appeals from the district court typically go to a particular appellate court, that's where the spouse must file their appeal against the interim order.
