Explanation using Example
Imagine a scenario where a factory has been illegally dumping toxic waste into a river, which is a source of water for multiple towns. This act of pollution constitutes a public nuisance as it affects the health and environment of the public at large. Under Section 91(1) of The Code of Civil Procedure, 1908, the Advocate-General may initiate a lawsuit against the factory for causing a public nuisance. Alternatively, if the court permits, a group of concerned citizens (at least two) who use the river water, even if they have not suffered any personal damage, may also file a suit seeking a court order to stop the factory from continuing its harmful activities and perhaps also seek remediation of the damage caused.
