Explanation using Example

Imagine a scenario where a local business owner files a suit against a state government department for not fulfilling a contract for office supplies. The court rules in favor of the business owner, issuing a decree that the state government department must pay damages to the business owner.

According to Section 82 of The Code of Civil Procedure, 1908, the business owner cannot immediately execute this decree against the state government department. Instead, they must wait for a period of three months from the date of the decree. Only if the decree remains unsatisfied after this period, can the business owner proceed with the execution of the decree to seek the damages awarded by the court.
