Explanation using Example

Imagine John had a debt owed to a bank as per a court decree, but he passed away before clearing the debt. The bank, as the decree-holder, can go to the court that issued the decree and request to execute the decree against John's estate. The court can allow the bank to recover the debt from John's assets that were inherited by his legal heirs.

If John's daughter, Emma, is the legal representative of his estate, she is responsible for paying the debt from the estate's assets. However, her personal assets are not at risk; she only has to use the assets of John's estate that she received. The court may ask Emma to provide the estate's financial accounts to determine the extent of the assets available to pay off the debt.
