Imagine a scenario where an individual, Mr. Sharma, has filed a suit in the High Court of Delhi against a company for breach of contract. However, Mr. Sharma believes that he may not receive a fair trial in Delhi due to the company's strong local influence and connections within the legal community there.
Concerned about the impartiality of the proceedings, Mr. Sharma decides to apply to the Supreme Court of India under Section 25 of The Code of Civil Procedure, 1908. He submits a motion supported by an affidavit, explaining why he believes justice would be better served if the case were transferred to another state, say the High Court of Karnataka.
The Supreme Court, after sending notices to all parties involved and hearing their arguments, agrees with Mr. Sharma. It finds that transferring the suit to Karnataka would indeed be expedient for the ends of justice. Consequently, the Supreme Court orders the transfer of the suit to the High Court of Karnataka, ensuring a fair and unbiased trial for Mr. Sharma.
