Explanation using Example

Imagine that Raj, who lives in Mumbai, sells goods to Sunita in Pune. The contract states that any dispute arising out of the transaction can be resolved in the courts of either Mumbai or Pune. When a dispute arises, Sunita files a suit in Pune. However, Raj believes that it would be more convenient for him to defend the case in Mumbai due to proximity to his place of business and witnesses. Therefore, Raj, upon receiving notice of the suit, applies to the Pune court at the first hearing to have the case transferred to Mumbai. The Pune court will hear Raj's reasons, consider any objections Sunita might have, and then decide if the case should be transferred to Mumbai or continue in Pune.
