Explanation using Example
Imagine Mr. Sharma owns two adjacent plots of land, Plot A and Plot B, which are located on the border of two jurisdictions: District X and District Y. A factory nearby has been polluting the area, causing damage to both plots. Plot A falls within the jurisdiction of Court X in District X, while Plot B falls under the jurisdiction of Court Y in District Y.
Under Section 17 of The Code of Civil Procedure, 1908, Mr. Sharma can file a suit against the factory in either Court X or Court Y, since part of the immovable property (either Plot A or Plot B) is located within their respective jurisdictions. However, he must ensure that the court he chooses can handle the full value of his claim for both plots combined.
