Explanation using Example
Imagine a new diagnostic center, "HealthScan Diagnostics," is set to open in the state of Himachal Pradesh. The owners are preparing to launch their services, which include MRI scans, CT scans, and X-rays. Before they can open their doors to the public, they need to comply with the Clinical Establishments (Registration and Regulation) Act, 2010.
As per Section 1(1) of the Act, they are aware that the Act is officially known as the Clinical Establishments (Registration and Regulation) Act, 2010. According to Section 1(2), since their establishment is in Himachal Pradesh, one of the states where the Act is initially applicable, they must register their clinical establishment under this Act.
They also know that as per Section 1(3), the Act has already come into force in Himachal Pradesh. Therefore, "HealthScan Diagnostics" must ensure they are in full compliance with the Act from the very beginning, which includes registration, adhering to the standards set by the Act, and any other regulations that may be applicable to their specific category of clinical establishment.
