Explanation using Example

Imagine a farmer, Mr. Sharma, who owns a piece of agricultural land in the Central Provinces. The record of rights, a legal document listing details of land ownership and obligations, incorrectly shows that a part of Mr. Sharma's land belongs to his neighbor, Mr. Patel. Mr. Sharma wants to correct this entry as it affects his legal rights over the land.

Under Section 120 of The Central Provinces Land-Revenue Act, 1881, Mr. Sharma can apply to the Deputy Commissioner for a correction in the record of rights. Since the error affects his ownership, he has an interest in getting the record corrected. The Deputy Commissioner can correct this entry on the following ground:

  • Mr. Sharma and Mr. Patel (all persons interested in the entry) mutually agree that the entry is incorrect and wish to have it corrected (ground a).

After reviewing the application and the mutual agreement between Mr. Sharma and Mr. Patel, the Deputy Commissioner corrects the record to accurately reflect the true ownership of the land. This correction ensures that Mr. Sharma's rights are protected and the land records are up to date and accurate.
