Explanation using Example

Imagine a farmer, Mr. Sharma, in the Central Provinces who has a dispute over the boundary lines of his land with his neighbor. The dispute arises during a period when a settlement operation is being conducted in their area, so the matter is taken up by a Settlement Officer specially appointed for the purpose of resolving issues during the land revenue settlement process.

However, before the Settlement Officer can reach a final decision on Mr. Sharma's case, the Chief Commissioner announces the completion of the settlement operation in the official Gazette. According to Section 39 of The Central Provinces Land-Revenue Act, 1881, the authority of the Settlement Officer to decide on the case ceases with this announcement.

Following this, Mr. Sharma's case, still unresolved, is transferred to the regular civil court that normally has jurisdiction over such land disputes, as directed by the Commissioner of the division. This ensures that Mr. Sharma's case will be heard and decided upon, despite the conclusion of the settlement operations.
