Explanation using Example

Example 1:

Scenario: Ramesh, a resident of Mumbai, was required to appear in court on 15th August 2023 as part of his bail conditions. He failed to appear on the specified date, thereby forfeiting his bond of ₹50,000 to the government. Despite receiving notice, Ramesh did not pay the forfeited amount or provide a valid reason for his absence.

Application of the Act: The court issues a Warrant of Attachment to the Police Officer in charge of the police station in Mumbai. The warrant authorizes the police officer to seize and detain any movable property belonging to Ramesh within the Mumbai district. If Ramesh does not pay the ₹50,000 within 15 days, the police officer is instructed to sell the seized property to recover the amount. The police officer must then report back to the court with details of the actions taken under the warrant.

Example 2:

Scenario: Priya, who lives in Delhi, was supposed to attend a court hearing on 1st September 2023 as part of her bail agreement. She did not show up, resulting in the forfeiture of her bond amounting to ₹1,00,000. Priya was notified but failed to pay the amount or justify her absence.

Application of the Act: The court issues a Warrant of Attachment to the Police Officer in charge of the police station in Delhi. The warrant directs the police officer to attach any movable property owned by Priya within the Delhi district by seizing and detaining it. If Priya does not pay the ₹1,00,000 within 10 days, the police officer is authorized to sell the attached property to recover the amount. The police officer must then submit a report to the court detailing the execution of the warrant.
