Explanation using Example
Example 1:
Rajesh, a 35-year-old man, was found guilty of theft under Section 379 of the Indian Penal Code. The value of the stolen goods was Rs. 30,000. The case was heard in the Court of a Magistrate of the first class. Given the sentencing powers of this court, the Magistrate sentenced Rajesh to two years of imprisonment and imposed a fine of Rs. 20,000. Additionally, Rajesh was ordered to perform 100 hours of community service, which involved cleaning public parks in his locality.
Example 2:
Meena, a 28-year-old woman, was convicted of causing grievous hurt under Section 325 of the Indian Penal Code. The case was heard in the Court of a Chief Judicial Magistrate. Considering the severity of the crime, the Chief Judicial Magistrate sentenced Meena to six years of imprisonment and imposed a fine of Rs. 1,00,000. Since the Chief Judicial Magistrate has the authority to pass any sentence except for death or life imprisonment or imprisonment exceeding seven years, the sentence was within the permissible limits.
Example 3:
