Example 1: Unauthorized Sub-letting

Introduction: Ramesh is a tenant living in a rented apartment in Guwahati, Assam. Due to a job transfer, he plans to move to another city temporarily and decides to sub-let his apartment to his friend, Suresh, without informing his landlord or entering into a supplementary agreement.

Application: According to Section 7(1)(a) of The Assam Tenancy Act, 2021, Ramesh cannot sub-let the premises without entering into a supplementary agreement to the existing tenancy agreement. Since Ramesh did not follow this procedure, he is in violation of the Act.
