Explanation using Example
Imagine a scenario where Company A and Company B have an arbitration agreement to settle disputes. Company A files an application in the Mumbai High Court concerning the arbitration process. According to Section 42 of The Arbitration and Conciliation Act, 1996, once the Mumbai High Court is approached for any application related to this arbitration, it will be the only court that can handle all matters related to this particular arbitration agreement and the proceedings that follow. Even if Company B later wants to approach the Delhi High Court for any reason related to this arbitration, they cannot do so because the Mumbai High Court has exclusive jurisdiction over this matter now.
