Explanation using Example
Imagine a lawyer named Mr. Sharma who was practicing in Delhi High Court before the implementation of The Advocates Act, 1961. Under Section 17 of the Act, the State Bar Council of Delhi would include Mr. Sharma's name and address in the roll of advocates. Since Mr. Sharma was already an advocate before the Act, his seniority would be determined based on his original date of enrollment under the Indian Bar Councils Act, 1926.
Moreover, if Mr. Sharma holds the designation of a senior advocate, his name would be entered in the first part of the roll dedicated to senior advocates. If he is not a senior advocate, his name would be listed in the second part for other advocates.
It's also important to note that Mr. Sharma cannot be enrolled on the advocates' roll of another State Bar Council simultaneously, as per subsection (4) of Section 17. Thus, if he decides to practice in Mumbai, he would have to transfer his enrollment to the Maharashtra State Bar Council and be removed from the Delhi roll.
