Explanation using Example
Imagine a scenario where a new form of public grievance arises due to the development of advanced technology, which is not adequately covered under the existing provisions of Article 32 of the Constitution of India. To address such grievances, Parliament decides to enact legislation that empowers the Supreme Court to issue specific orders or writs to regulate this technological domain.
Under the new law, the Supreme Court may now issue a mandamus to a governmental agency directing it to properly manage the disposal of electronic waste, which has become a severe environmental issue. This extension of power is in line with Article 139, allowing the Supreme Court to deal with new and unforeseen challenges that require judicial intervention beyond the original scope of Article 32.
