Explanation using Example
Imagine the Supreme Court of India is facing a shortage of judges due to several vacancies, and there is a significant backlog of cases. To address this issue, the President of India, with the recommendation of the National Judicial Appointments Commission, gives consent to request a retired Supreme Court judge to temporarily serve on the bench to help clear the backlog. The retired judge agrees to assist and is thus appointed to sit and act as a judge of the Supreme Court for a limited period. During this time, the judge is entitled to allowances as determined by the President and has the same jurisdiction, powers, and privileges as current judges of the Supreme Court, although they are not officially considered a current member of the court. This is an application of Article 128 of the Constitution of India.
