Explanation using Example
Imagine a situation where Mrs. Sharma is the Deputy Chairperson of the Rajya Sabha. She has been elected as a member of the Rajya Sabha from the state of Rajasthan. Three years into her term, she decides to resign from her membership of the Rajya Sabha due to personal reasons.
As per Article 90(1) of the Constitution of India, the moment Mrs. Sharma resigns her membership from the Rajya Sabha, she will automatically vacate her office as the Deputy Chairperson, because holding that office is contingent upon her being a member of the council.
Alternatively, if Mrs. Sharma wishes to resign only from the Deputy Chairperson position but retain her membership in the Rajya Sabha, she can do so under Article 90(2) by submitting a written resignation addressed to the Chairperson of the Rajya Sabha.
Lastly, if a situation arises where the members of the Rajya Sabha are not satisfied with Mrs. Sharma's performance as the Deputy Chairperson, they have the right under Article 90(3) to pass a resolution for her removal. However, they must ensure that the resolution is supported by a majority of all the then members of the Rajya Sabha and that Mrs. Sharma is given at least fourteen days' notice before the resolution is moved.
