Explanation using Example
Imagine a scenario where an individual believes their right to equality before the law, as guaranteed under Part 3 of the Indian Constitution, has been violated by a public university's admission policy. The individual decides to file a lawsuit against the university. In this context, “the state” as mentioned in Article 36 is interpreted to include all branches and agencies of the government, including the public university. This means that the individual can invoke the rights against the university as it falls under the definition of the state for the application of fundamental rights.
