Explanation using Example
Imagine a small town where a group of Christian residents decide to establish a school that incorporates their religious values into the curriculum. They invest in property and develop an educational institution which they administer. This is their right under Article 30(1) of the Constitution of India, allowing them to maintain their religious teachings within the educational framework.
Several years later, the local government plans to build a public park and requires the land on which the school is situated. According to Article 30(1A), if the government decides to acquire this property, it must ensure that the compensation for the land is fair and does not infringe upon the community's right to run their educational institution. Thus, the government must provide adequate funds or alternative property to ensure the school can continue to operate elsewhere without financial hardship.
Furthermore, when the state government announces a scheme to provide grants to schools for infrastructure development, the Christian-managed school applies for aid. Under Article 30(2), the state must consider the application without prejudice, meaning the school should receive funds on par with other non-minority institutions, without discrimination due to its Christian management.
