Explanation using Example
Imagine a factory that processes chemicals and produces waste that contains harmful substances. According to Section 24 of The Water (Prevention and Control of Pollution) Act, 1974:
The factory owner must ensure that the waste, which could contain poisonous or polluting matter, does not enter any nearby streams, wells, or the land itself. If, for example, the factory's waste treatment process is not up to the standards set by the State Board, and pollutants from the waste enter a nearby river, the factory owner would be violating clause (a) of Section 24(1).
However, if the factory is constructing a new drainage system that is approved and does not release pollutants into the waterways, as per the exceptions listed in Section 24(2), then the factory owner would not be committing an offense under this section.
