Explanation using Example

Consider a scenario where Mr. John is a member of a Water Pollution Control Board. Recently, he was declared insolvent by a court of law due to his inability to pay his debts. As per Section 6 of The Water (Prevention and Control of Pollution) Act, 1974, Mr. John is no longer eligible to be a member of the Board because clause (a) states that no person shall be a member of a Board, who is, or at any time has been adjudged insolvent or has suspended payment of his debts or has compounded with his creditors.

Before his removal, the Central or State Government, as applicable, would provide Mr. John a reasonable opportunity to present his case as per subsection (2) of Section 6. If he is removed, according to subsection (3), he will not be eligible for renomination as a member of the Board.
