Explanation using Example
Imagine that Raj and Simran enter into a contract where Raj agrees to sell his property to Simran. However, after receiving the initial deposit, Raj changes his mind and refuses to complete the sale. Simran, eager to own the property and having no equivalent alternative, seeks a legal remedy.
In this scenario, under Section 15(a) of The Specific Relief Act, 1963, Simran, as a party to the contract, has the right to approach the court and ask for the specific performance of the contract. This means that the court can order Raj to fulfill his obligation and transfer the property to Simran as per the terms of the original agreement, rather than just compensating Simran for the loss.
