Explanation using Example

Imagine Sarah purchases a new smartphone from a retail store. She expects that:

  • (a) The store legally owns the smartphone (or will own it at the time of delivery if it's on backorder) and has the right to sell it to her.
  • (b) She can use her smartphone without interference from the store or previous owner claiming it back.
  • (c) The smartphone isn't subject to a loan or lien that she wasn't told about, meaning no one can come to claim money from her for the phone after she buys it.

If any of these expectations are not met, Sarah may have legal recourse under the Sale of Goods Act, 1930.
