Explanation using Example
Imagine a private school, Sunshine Academy, that falls under sub-clause (iv) of clause (n) of section 2 of the Right of Children to Free and Compulsory Education Act, 2009. This school is required to reserve 25% of its seats in class I for children from weaker sections and disadvantaged groups from its local area. Let's say the class has a capacity of 40 students; therefore, Sunshine Academy must admit 10 students who qualify under this provision and provide them with free education.
For the education of these 10 students, the school is entitled to reimbursement from the government. If the school's annual per-child expenditure is Rs. 15,000 and the state's per-child expenditure is Rs. 12,000, Sunshine Academy will be reimbursed the lesser amount, which is Rs. 12,000 per child. However, if Sunshine Academy had received land or facilities at a discounted rate with a condition of providing free education to certain children, they would not be reimbursed for these particular students to the extent of their obligation.
Furthermore, Sunshine Academy must regularly submit information regarding the admission and education of these students to the local government or authority as required for compliance and monitoring purposes.
