Explanation using Example
Imagine a real estate developer, Mr. Sharma, has submitted an application to register his new housing project with the Real Estate Regulatory Authority (RERA) as required by law. According to Section 5(1) of The Real Estate (Regulation and Development) Act, 2016, the Authority must, within 30 days, either:
- Grant registration to Mr. Sharma's project, providing him with a registration number, login ID, and password to access the Authority's website, where he can create a web page for his project and enter its details, or
- Reject the application, stating the reasons in writing, but only after giving Mr. Sharma a chance to be heard regarding any issues with his application.
If the Authority does not respond within the 30-day window, as per Section 5(2), Mr. Sharma's project will be deemed registered. The Authority must then provide him with the registration number and login credentials within seven days after the 30-day period lapses.
The validity of the registration, as stated in Section 5(3), will be for the duration Mr. Sharma declared necessary to complete the project or its phase when he submitted his application.
