Explanation using Example
Imagine a scenario where the Central Government is tasked with establishing a new Central Council to oversee the standards of pharmacy education and practice in India. According to Section 3 of The Pharmacy Act, 1948, the government begins by selecting members for this council.
They reach out to the University Grants Commission (UGC) to elect six members who are experts in pharmaceutical subjects to join the council. These members include esteemed professors from various universities who specialize in pharmaceutical chemistry, pharmacy, pharmacology, and pharmacognosy.
Simultaneously, the Central Government nominates six professionals with degrees or diplomas in pharmacy or pharmaceutical chemistry, ensuring that at least four of them are currently practicing in the field.
The Medical Council of India holds an internal election to choose one of their members to represent them on the Central Council.
The Director General of Health Services, the Drugs Controller of India, and the Director of the Central Drugs Laboratory are included as ex officio members due to their pivotal roles in the healthcare system.
The council also welcomes representatives from the UGC and the All India Council for Technical Education to provide educational insights.
Furthermore, each State Council elects a registered pharmacist to represent their state, while the State Governments nominate another registered pharmacist for the same purpose.
For the Union territories, the government nominates individuals eligible for registration under section 31 of the Act, as a temporary measure for the first five years following the 1976 amendment of the Pharmacy Act.
Once all members are selected, the Central Council convenes to set forth policies and regulations that will enhance the quality of pharmacy education and practice across India.
