Explanation using Example

Imagine you are an inventor who has developed a new kind of eco-friendly fuel. To protect your invention, you decide to file a patent application.

According to Section 10 of The Patents Act, 1970, your patent application should contain a specification that describes your invention in detail. The title of your application could be "Eco-friendly Fuel Composition". This title indicates the subject matter of your invention.

In your application, you might include drawings of the chemical structure of your new fuel, as these would help to explain your invention. If the Controller finds these drawings necessary, they will be considered part of your specification.

If the Controller needs further clarification, they may ask for a model or sample of your fuel. This won't be part of your specification, but it will help to illustrate your invention.

Your complete specification must describe your invention and its use, disclose the best method of producing your fuel, and end with a claim defining the scope of your invention. For example, you might claim the specific composition of your fuel and the method of producing it.

If you used a specific strain of algae to produce your fuel and this strain isn't publicly available, you'll need to deposit a sample at an international depository authority and include details of this deposit in your specification.

Your patent application would be considered complete when it includes all these elements. If you later develop an improved method of producing your fuel, you can file a complete specification after your provisional one, including claims about this development.
