Explanation using Example

Imagine a scenario where an individual named Raj is found to be manufacturing and selling a cough syrup containing a manufactured drug without the necessary license required under the Narcotic Drugs and Psychotropic Substances Act, 1985. Upon investigation, it is discovered that the quantity of the drug involved is above the defined 'small quantity' but below the 'commercial quantity'. Raj is arrested and brought to trial.

In court, it is determined that Raj's actions are in contravention of the Act for manufacturing and selling a preparation containing a manufactured drug without authorization. As per Section 21, since the quantity involved is more than small but less than commercial, Raj is sentenced to rigorous imprisonment for a term that may extend up to ten years, and he is also fined an amount that may extend up to one lakh rupees.
