Explanation using Example
Imagine that Ravi filed a suit for property possession against Suresh on January 1, 2020. The court proceedings continued, and Ravi diligently pursued the case. However, on December 1, 2020, the court discovered that it did not have the jurisdiction to hear the property dispute. Ravi, upon learning this, filed a new suit in the correct court on December 20, 2020.
Under Section 14 of The Limitation Act, 1963, the time Ravi spent prosecuting the first suit (from January 1, 2020, to December 1, 2020) would not be counted against him when calculating the limitation period for the second suit. This means that even if the limitation period for filing the suit was one year and would have normally expired on December 31, 2020, Ravi's prompt refiling in the correct court would still be considered timely because the time during which he was engaged in the first proceeding is excluded from the limitation calculation.
